Nach der Versteigerung im Mai 2007 und der kurz darauf erfolgten Kündigung der Mietverträge war die Lage der Köpi monatelang völlig unklar. Mittlerweile aber hat sich eine Situation ergeben, in der zumindest einige konkrete Fakten vorliegen – daher dieses Update.
Es ist uns in langwierigen und schwierigen Verhandlungen mit dem Eigentümer des Hauses gelungen, den Fortbestand der Köpi als Wohn- und Kulturprojekt zunächst einmal zu sichern.
Ursprünglicher Ansatz in den Verhandlungen war die Idee, den gesamten Köpi-Komplex für eine lange Laufzeit komplett in Selbstverwaltung (z.B. in Form eines Erbpachtvertrages) zu übernehmen und die Köpi so dauerhaft dem kapitalistischen Verwertungskreislauf zu entziehen.
Eine derartige Lösung scheiterte jedoch an der Hauptgläubigerin immer noch weitgehende Vetorechte besitzt (und diese, wie gehabt, gegen die Köpi nutzt). Also haben sich unsere Bemühungen im folgenden auf eine ausdrückliche Bestätigung bzw Verlängerung der bestehenden Mietverträge konzentriert.
Der Eigentümer der Köpi hat im Ergebnis pünklich zum 18. Köpi Geburtstag die Mietverträge zu den bestehenden Konditionen für alle im Erdgeschoß liegenden Wohn- und Veranstaltungsräume um 30 Jahre verlängert. Die zum 31.Mai ausgesprochenen Kündigungen der Wohnmietverträge wurden zurückgenommen. Somit gibt es keinerlei ungeklärte Rechtsposition auf dem gesamten Hausgrundstück mehr: Alle Räumlichkeiten sowie Hof und Garten haben ausdrückliche wirksame Mietverträge.
Diese Mietverträge erlauben uns einen Fortbestand der Köpi auf absehbare Zeit, ohne dass wir an unserem Konzept, bezahlbaren Wohn- und Kulturraum zu bieten, Abstriche machen mussten.
Unser Konzept: "Köpi bleibt – und zwar so wie sie ist!“ ist und war für uns nie verhandelbar!
Dieser vorläufige Erfolg wäre niemals möglich gewesen ohne die großartige Unterstützung, die wir von Tausenden Freundinnen und Freunden aus aller Welt erhalten haben.
Erst die vielfältige Unterstützung, die Demos, Soliaktionen, Spenden, der massive öffentliche Druck haben uns in eine ausreichend starke Position versetzt, um in den Verhandlungen mit dem Eigentümer eine (bereits geplante) Räumung des Hauses abzuwenden. Allen UnterstützerInnen darum nochmals ein großes Danke – ohne Euch hätten wir das nie geschafft!

Aber auch wenn die unmittelbare Räumungsdrohung für das Haus abgewendet ist bedeutet das nicht, daß wir uns nun zurücklehnen können.
Die langfristige Situation des Wagenplatzes ist nach wie vor ungeklärt. Zwar gibt es eine vorläufige Duldungsvereinbarung mit dem Eigentümer, es wurde aber keine langfristige vertragliche Sicherung durch einen Pachtvertrag oä. erreicht. Somit kann zwar akut nicht geräumt werden, sollten die Köpi Grundstücke aber erneut den Besitzer wechseln, wäre der nächste Konflikt vorprogrammiert. Hier gilt es also, weiterhin wachsam zu bleiben. Bitte haltet Euch auf dem Laufenden und erscheint trotz dieses Zwischenerfolges zahlreich zu den Aktionstagen Ende Mai und zeigt der Öffentlichkeit, dass man Projekte wie die Köpi nicht so einfach aus dem Stadtbild entfernen kann.
Außerdem gilt es, Solidarität auch mit den andereren akut räumungsbedrohten Freiräumen in dieser Stadt zu zeigen. So ist die Lage der Rigaer 94, des XB-Liebig und des Schwarzen Kanal weiterhin kritisch.
Am Beispiel der Köpi zeigt sich, daß massiver öffentlicher Druck etwas erreichen kann. Wir sehen die einstweilige Rettung der Köpi nur als eine Zwischenetappe im Kampf um den Erhalt aller linken Freiräume.

After the auction in March 2007, and the following cancellations of the house contracts, the future of Köpi was unclear. But since then, the situation has changed in some concrete ways – therefore this update.
It came to long and hard negotiatons with the new owner of the house to secure the Köpi as a living and cultural project.
The first priority in the negotiations was the idea to bring the whole of the Köpi complex, for an extended length of time, under self-management (eg. in the form of a contract that is continueously passed on i.e. that is linked to the project and not specific people so that it has no ending). We wanted to keep the Köpi for as long as possible out of the capitalist economy.
A possible solution was cancelled by the Commerzbank, who, still officially, has veto rights (and is still using them against the Köpi). Therefore, we have concentrated on maintaining the present contracts and getting them extended.
On the 18th birthday of Köpi, the owner gave contracts, based on the conditions for the rest of the house, to the whole ground floor, the first floor and the side wing (the concert spaces, some living spaces and the office) for 30 years. The cancellation of the old contracts for the rest of the house for the 31st of May have also been withdrawn. Through this, there are no longer any unclear legal positions for the whole house and the land it sits on, i.e. all rooms, including the yard and the land in front all are covered by contracts.
These contracts allow us a continues existance for an unforseeable length of time, without us having to compromise or bring to an end our concept of a non-commercial living and cultural centre.
Our concept: „Köpi stays – and the way it is!“ is and was not negotiable.
This success would not of been possible without the help and support of our thousands of friends from around the world.
The various acts of support, the demos, solidarity actions, donations, the massive publicity, created a lot of pressure and put us in a strong position with regards to negotiating with the owner to halt his plans for an eviction of the house. To all our supporters, once again, a massive thank you - we could not of done it without you.

However, even though the threat of eviction has been lifted from the house, this does not mean that we can sit back.
The situation that has existed for a long time with regard to the Köpi Trailer Park is still unclear. There exists at the moment an allowance by the owner but there is still no long-term contractual solution. At the moment there is no danger of eviction but if the owner of the land changes, the next conflict will be forseeable. We need to stay alert. Please keep your eyes open and come to the action days at the end of May and show that they cannot push projects like the Köpi out of the life of our city’s so easily.
Apart from that, we still need to show solidarity with the other projects in Berlin that are faced with eviction. The situation being faced by Rigaer 94, XB-Liebig, Liebig 14 and Schwarzer Kanal remains critical.
The example of the Köpi shows that through massive public pressure, we can win. We see the saving of the Köpi as just a small step in the struggle for the maintaining of all our free spaces.

Efter salgsauktionen i maj 2007 blev lejekontrakterne opsagt og Köpis situation var fuldstændig uklar i månedsvis. I mellemtiden er der nu opstået en situationen, som i det mindste byder på nogle konkrete facts. Derfor denne ajourføring.
Gennem langvarige og vanskelige forhandlinger med husets ejer har vi indtil videre opnået at sikre videreførelsen af Köpi som bolig - og kulturprojekt.
Vores oprindelige udgangspunkt i forhandlingerne var ideen om at overtage hele Köpi-komplekset med fuldstændig selvforvaltning for en langvarig periode - f.eks. i form af en lejekontrakt, som kan overdrages til den næste generation "Erbpachtvertrag". Dermed ville vi trække Köpi helt ud af det kapitalistiske profit- og spekulationskredsløb.
En sådan løsning mislykkedes, da hovedaktionæren stadig væk har udbredt vetoret og selvsagt bruger denne mod Köpi. Af den grund har vi koncentreret vores bestræbelser på henholdsvis at få bekræftet og forlænget de eksisterende lejekontrakter.
Det resulterede i, at Köpis ejere lige i rette tid op til Köpis 18-års fødselsdag, forlængede samtlige lejekontrakter for boligerne og aktivitetslokalerne i stueetagen. Forlængelsen gælder for 30 år. De opsigelser af boligerne, som skulle gælde fra 31. maj 08 er blev trukket tilbage. Dermed er der ikke længere uafklarede retslige spørgsmål hvad angår ejendommens areal: Alle rum samt gården og haven har fuldt ud gældende lejekontrakter.
Disse lejekontrakter tillader at Köpi forsat kan eksistere i en rum tid, uden at vi må give afkald på vores forestillinger om at fremme bolig - og kulturrum for enhver til en billig penge. Vores koncept "Köpi bliver - sådan som det er", er og var aldrig til forhandling/disposition! Dette foreløbige resultat ville aldrig have været muligt uden den storartede støtte, som vi har modtaget fra tusinderaf veninder og venner fra hele verden. Det var den mangfoldige støtte, så som demos, solidaritetsaktioner, økonomisk støtte og massivt offentligt pres, der har givet os en tilstrækkelig stærk position til, at vi via forhandlinger med ejeren kunne afværge den rydning af huset, som egentlig allerede var planlagt. Thanks For All The Support - We Will Never Forget It ! Selv om den umiddelbare rydningstrussel er taget af bordet, betyder det ikke, at vi nu mageligt kan læne os tilbage. Skurvognslandsbyen´s situation er på længere sigt stadig væk uafklaret. Skønt ejeren foreløbigt har indgået en aftale om at tolerere skurvognslandsbyen, er der ikke opnået nogen regulær kontrakt med en langvarig sikring. Dermed er der ingen akut fare for rydning af pladsen. Men i tilfælde af at Köpi får nye ejere, er den næste konflikt forprogrammeret. Her gælder det om at forblive på vagt. Vi beder jer om at holde jer løbende underrettet og på trods af denne delsejr møde talstærkt op til aktionsdagene i slutningen af maj. Vi skal vise offentligheden, at projekter som Köpi ikke bare kan fjernes fra bybilledet. Derudover gælder det om at vise solidaritet med de andre rydningstruede frirum i denne by. Situationen er stærk kritisk for Rigaer 94, XB-Liebig og Schwarzen Kanal. Historien om Köpi viser, at ved massivt offentligt pres kan der opnås noget. Vi anser den midlertidige redning af Köpi som en mellemetappe i kampen for bevaring af alle venstreorienterede frirum. Deltag i frirum-dagene den 11.+12.april! Po aukci, která se konala v březnu 2007, následovalo zrušení smluv a budoucnost Köpi byla nejasná. Ale od té doby se situace změnila v konkrétních věcech - proto poskytujeme tyto aktuální informace.
Došlo k dlouhým a obtížným jednáním s novým majitelem domu. S cílem zabezpečit Köpi coby místo k bydlení a coby kulturní projekt.
Hlavním cílem vyjednávání byla myšlenka udržet projekt Köpi v jeho celku, na prodlouženou dobu, coby samosprávné místo (např. formou smlouvy, která bude nepřetržitě předávána a bude se vztahovat k projektu a nikoli k určitým lidem, aby mohla fungovat nekonečně). Chtěliy jsme udržet Köpi tak dlouho, jak to jen půjde, mimo kapitalistickou ekonomiku.
Možné řešení bylo zrušeno Commerzbankou, která stále disponuje právem veta (a pořád je proti Köpi používá). Proto jsme se zaměřiliy na udržení současných smluv a dosažení jejich prodloužení.
Na 18. narozeniny Köpi, jsme od majitele dostaliy smlouvy založené na podmínkách pro zbytek domu, pro celé přízemí, první patro a postranní křídlo (koncertní sály, některé pokoje k bydlení a kancelář) na dobu 30ti let. Zrušení starých smluv pro zbytek domu určené na 31. května bylo také staženo. Díky tomu už nejsou žádné nejisté soudní stanoviska pro celý dům, ani půdu, na níž stojí, všechny pokoje, včetně dvora a pozemku před domem. Všechny mají smlouvy.
Tyto smlouvy nám umožňují pokračovat na nepředvídatelně dlouhou dobu, aniž bychom museliy dělat kompromisy nebo ukončit náš koncept nekomerčního bydlení a kulturního centra.
Náš koncept: "Köpi zůstane - takové, jaké je!" nesnesl ústupky.
Tento úspěch by nebyl možný bez pomoci a podpory tisíců přátel po celém světe.
Různé akce na podporu, demonstrace, solidární akce, dary, obrovská publicita, to všechno dalo vzniknout silné pozici v rámci jednání s majitelem, a tak zastavilo jeho plány na vystěhování domu. Všem našim podpůrcům.kyním, ještě jednou, obrovské díky - bez vás bychom to nezvládliy.
Nicméně, i přesto, že z domu byla sňata hrozba vystěhování, neznamená to, že můžeme nečinně sedět.
Situace, která dlouho existuje ohledně Köpi Trailer Park, je stále nejasná. V současnosti jej majitel toleruje, ale stále nemáme dlouhodobé smluvní řešení. Aktuálně nehrozí vystěhování, ale pokud se změní majitel pozemku, objeví se nový konflikt. Musíme zůstat ostražití.é. Prosíme, mějte oči otevřené a přijďte na dny akcí na konci května a ukažte jim, že nemohou odsunout projekty jako je Köpi pryč z života našeho města tak snadno.
Mimo to stále potřebujeme ukázat solidaritu s ostatními projekty v Berlíně, kterým hrozí vystěhování. V takové situaci se ocitly Rigaer 94, XB-Leibig, Leibig 14 a Schwarzer Kanal a jejich situace zůstává kritická.
Na příkladu Köpi je vidět, že pomocí obrovského veřejného tlaku můžeme zvítězit. Zachování Köpi chápeme pouze jako malý krůček v boji za udržení všech svobodných prostor.
